Accept Corrective Polk County Utilities Easement in conjunction with proposed development along Schoolhouse Road as requested through the Development Review Process. (No fiscal impact)

DESCRIPTION
As a result of a proposed residential development, the County, through its Development Review Process, has requested a utility easement for the construction and/or future maintenance of utility facilities adjacent to the development. The development located along the east side of School House Road in the Lakeland area is proposing to make a connection to existing wastewater facilities to the north and east of the development; however, an easement over the adjacent property, owned by SPT WAH Wilmington, LLC, is needed to make the connection. The developer coordinated the granting of a Polk County Utilities Easement from the adjacent owner; however, the easement was inadvertently recorded by the adjacent owner in O.R. Book 13727, at Pages 765 through 767 prior to acceptance by the Board and with an erroneous legal description. Accepting the Corrective Polk County Utilities Easement will give the County the easement needed for the proposed connection to the existing force main in conjunction with the proposed development.
RECOMMENDATION
Request Board accept the aforementioned Corrective Polk County Utilities Easement.
