DESCRIPTION

The owner of a tract of land located along the west side of H.L. Smith Road to the north of Lake Mabel Loop Road contacted the County regarding a matter that appeared on a recent title search done in conjunction with a proposed residential development.  Several deeds in the chain of title dating back as far as 1931 for the nearly 10-acre tract contain a statement appended to the legal description reserving an easement for public highway purposes along the southerly and easterly sides of the tract.  However, no width is stated for the reserved easement which is creating a cloud on the title to the entire tract.    The owner has requested a release of whatever interest the County’s may have in the tract to clear any clouds on the title to its property caused by the reservation statements in the chain of title.  The County has no need or use for the tract with the exception of what is needed for the existing County roadway located along the eastern boundary and a legal description was prepared for the tract less and except the existing documented right-of-way for H.L. Smith Road.  Authorizing a County Deed to Woodland Ranch Estates 3, LLC for the tract, less any existing County road right-of-way, will release any interest the County may have in the subject property to it in an attempt to clear any clouds on the title caused by the reservation.

RECOMMENDATION

Request Board authorize the aforementioned County Deed to Woodland Ranch Estates 3, LLC.
