DESCRIPTION
The Code Enforcement Special Magistrate is responsible for hearing code enforcement cases. These cases are heard once a month and are scheduled weeks in advance. An Alternative Special Magistrate is needed for those times when the Special Magistrate is not available to hear the scheduled cases. The Polk County Special Magistrate Ordinance limits the Alternate Special Magistrate term to two years. The Ordinance also requires that the Alternate Special Magistrate be an attorney who is in good standing with the Florida Bar Association, that they have a residence or business in Polk County, and that they not hold another elected or public office in Polk County. Jillian Spangler meets these qualifications.
The Agreement provides the Law Firm payment at a rate of $100 per hour for actual time the Alternate Special Magistrate spends in hearings. Additionally, the Law Firm provides payment at a rate of $100 per hour, with a cap of three (3) hours per hearing date for actual time spent be the Alternate Special Magistrate on tasks completed outside of the hearing. The term of the Agreement is from July 1, 2025 to June 30, 2027.
RECOMMENDATION
Reappoint Jillian Spangler as an Alternate Code Enforcement Special Magistrate for an initial term starting on July 1, 2025 and ending June 30, 2027 and approve the Alternate Code Enforcement Special Magistrate Agreement with Boswell and Dunlop, LLP.
FISCAL IMPACT
Funds are available in the General Fund within the Code Enforcement budget.
