DESCRIPTION

653th, LLC is the developer of a residential subdivision known as Serenity at Peace Creek Reserve located along Old Bartow/Lake Wales Road.  The plat for Serenity at Peace Creek Reserve was recently approved by the City of Winter Haven and subsequently recorded in Plat Book 217, at Pages 43 and 44.  The development lies adjacent to Old Bartow/Lake Wales Road and due to the fact that the existing right-of-way for the County roadway was not up to current county road classification standards the developer previously conveyed right-of-way to the County prior to the plat.  After the conveyance of the right-of-way and prior to the plat it was determined that the right-of-way previously conveyed did not accommodate a small portion of the sidewalk adjacent to, and constructed in conjunction with, the development.  To accommodate the sidewalk portion a right-of-way parcel identified as Tract “H” included on the plat which is to be conveyed by separate instrument as additional right-of-way for Old Bartow/Lake Wales Road.  Accepting the Quit Claim Deed will give the County the right-of-way needed to accommodate the sidewalk adjacent to the development and the roadway.

RECOMMENDATION

Request Board accept the aforementioned Quit Claim Deed.
