Approve Amendment to Non-Exclusive Perpetual Easement between the Southwest Florida Water Management District and Polk County in conjunction with the Panther Point Trail and Hampton Reserve Trailhead. (No fiscal impact)

DESCRIPTION
The State of Florida, Department of Transportation through its Florida's Turnpike Enterprise ("FTE") has a project to construct a segment of a new limited access toll road facility known as the Central Polk Parkway (SR 570B) from Polk Parkway (SR 570) at Winter Lake Road (SR 540) to US Highway 17 which recently entered the construction phase. FTE's project will impact multiple properties and facilities owned and/or operated by the County along the project corridor and the County entered into a Memorandum of Agreement ("MOA") with FTE in September 2022 which address those impacts. One such impact is the bifurcation of the existing Panther Point Trail which severs it from the Hampton Reserve Trailhead near its connection point. In accordance with the MOA the FTE has agreed to construct a replacement trailhead to the south of its current location and realign the existing trail to connect with the new trailhead. As part of the replacement trailhead and realigned trail the FTE agreed to coordinate a modified easement from the landowner, Southwest Florida Water Management District ("SWFWMD") to replace what was lost due to the road project. SWFWMD has agreed to the request and has approved and executed an Amendment to Non-Exclusive Perpetual Easement which amends and adds an additional segment of easement to accommodate the realignment. Approving the Amendment to Non-Exclusive Perpetual Easement will give the County an easement over the realigned trail in accordance with the MOA with FTE.
RECOMMENDATION
Request Board approve the aforementioned Amendment to Non-Exclusive Perpetual Easement.
