DESCRIPTION

Effective January 1st, 2023, Chapter 50, Florida Statutes, Legal and Official Advertisements, provides that a governmental agency may publish certain statutorily required legal advertisements, publications, or notices on the publicly accessible website of the county in which it lies if doing so would cost less than publishing legal notices in a newspaper. The Board of County Commissioners intends to continue publishing notices and advertisements in newspapers alongside publications on the Publicly Accessible Website. This Resolution clarifies that the version posted on the Publicly Accessible Website is the official and controlling version. Discrepancies should be resolved in favor of the online version. These discrepancies might include the language used and the date of publication.

 

RECOMMENDATION

Approve and adopt a resolution directing departments and divisions to publish legally required advertisements and public notices in both a newspaper and on the Publicly Accessible Website, and establishing publications on the Polk County Publicly Accessible Website to be the official and controlling version.

 

FISCAL IMPACT

There is no fiscal impact to the County.
