DESCRIPTION

The County contracted with Duncan Associates (the “Consultant”) to prepare a Transportation Impact Fee Update Study.  The final study, dated January 2023, is recommended by staff for consideration by the Board (the “Study”).  Based on recommendations of the Consultant and direction from the Board given during its January 17, 2023 work session, staff has prepared the attached ordinance for the Board’s consideration.  The proposed ordinance, which would take effect on June 30, 2023 if approved, provides for: (1) the approval and adoption of the Study; (2) the imposition of updated transportation impact fees at the phased-in rates set forth in the ordinance and in accordance with section 136.31801(6)(c), Florida Statutes; (3) incorporation of a revised benefit district map; and (4) revisions to section 2.11(F) to clarify its applicability to land donations only.

 

RECOMMENDATION

Adopt ordinance amending Ordinance 2019-056, the Polk County Amended and Restated Comprehensive Impact Fee Ordinance, for purposes of adopting the Study, imposing updated rates for Transportation Impact Fees, and amending various other provisions of the ordinance.

 

FISCAL IMPACT

Board approval of the impact fee rates set forth in the proposed ordinance will mean additional revenue for the Board of County Commissioners to build road infrastructure for growth related needs.  Without the increase, current rates are estimated to generate $147.4 million in revenue over the next 6 years, through FY 27/28.  If the Board approves the 4 phases of increased impact fee rates, as identified in the proposed ordinance, the estimate through FY 27/28 increases by $48.1 million to $195.5 million in revenue over the next 6 years.
