Ratify a Special Warranty Deed from Hartford Terrace Community Development District, for additional right-of-way. (No fiscal impact)

DESCRIPTION
Pulte Home Company, LLC is the developer of a residential subdivision known as Hartford Terrace Phase 2B located to the east of US Highway 27 in Davenport. A plat for Hartford Terrace Phase 2B was approved by the City of Haines City and subsequently recorded in Plat Book 212, at Pages 14 through 19, Public Records of Polk County. A right-of-way tract identified as Tract RW-1 on the plat was dedicated to the Hartford Terrace Community Development District (“CDD”), was subsequently conveyed by the developer to the CDD, and, based on language contain in the plat, is to be conveyed to Polk County. The additional right-of-way tract supplements, and could be utilized in conjunction with, existing public rights-of-way in the area for a future roadway connection between Holly Hill Road and US Highway 27. The CDD executed a Special Warranty Deed to the County for the above-mentioned tract; however, the deed was previously and inadvertently recorded by the owner in O.R. Book 13975, at Pages 633 through 635, prior to acceptance by the Board. Accepting and ratifying the Special Warranty Deed will give the County ownership of the right-of-way tract adjacent to the development.
RECOMMENDATION
Request Board accept and ratify the aforementioned Special Warranty Deed.
