DESCRIPTION
The County has received a petition from Stanley and Pat Erickson, and Michael and Karie Insua, to vacate any public interest the County may have in that 30-foot-wide strip of land lying adjacent to the east of Parcel ID Numbers 272822-000000-031010/031030 which is currently mapped as right-of-way on the Property Appraiser's tax maps and presumed to be public right-of-way. The subject lies in Section 22, Township 28 South, Range 27 East.
Multiple deeds in the chain of title associated with the above listed parcels going back at least 70 years lessed out strips of land with a statement that said strips are to be used for public highway purposes. The strip lying adjacent to the above listed parcels is mapped as right-of-way on the Property Appraiser maps; however, no evidence could be located that the strip of land was ever conveyed or dedicated to the County or the public and it is unclear whether or not the strips were ever utilized for road purposes but are presumed to be public right-of-way. The petitioners have requested the vacation to remove any public interest by the County that may exist in the strip of land in an attempt to clear any clouds on the title to their properties associated with the language in chain of title. The County recently approved a Release of Easements for recorded easements lying adjacent to the subject area at the request of the adjacent property owner in conjunction with proposed development. Neither the subject area nor the adjacent easement areas are being utilized by the County for roadway, or any other, purposes. Approving the vacation will remove any interest the County, or the public, may have in the subject 30-foot-wide strip in an effort to clear any clouds on the petitioner...
