DESCRIPTION

Polk County Utilities operates and maintains a wastewater lift station, and related facilities, within the Pine Pointe at Astonia subdivision in its Northeast Regional service area.  The lift station, known as Lift Station Number 406, is situated on a parcel identified as Tract D on the plat of Pine Pointe at Astonia recorded in Plat Book 210, at Pages 1 through 4.  The tract was designated as a lift station site by the plat; however, it was not dedicated to the County.  Fee simple ownership of the tract remains vested in the name of the developer, Pine Tree Trail Property, LLC and the tract was dedicated, along with other commons areas, to the Astonia Community Development District (“CDD”) by the plat.  Both the Developer and the CDD have expressed that they wish to donate and convey their interests in the tract for its continued use as a lift station site and have executed a Warranty Deed and Quit Claim Deed, respectively, to Polk County.  Accepting the above-mentioned Warranty Deed and Quit Claim Deed will allow the county to take fee simple ownership of the parcel for the continued operation and maintenance of the lift station.

RECOMMENDATION

Request Board accept the Warranty Deed from Pine Tree Trail Property, LLC and Quit Claim Deed from Astonia Community Development District.

No fiscal impact.
