DESCRIPTION
The County, in accordance with the Florida Building Code, requires that constructed improvements be permitted and inspected as part of the original construction process. However, there are unrecorded subdivisions within unincorporated Polk County where for twenty years or more a significant number of property owners have made property improvements without obtaining a required permit.
Because the County has limited resources to inspect previously constructed improvements within such unrecorded subdivisions, on October 1, 2024, the Board of County Commissioners adopted Ordinance 2024-065 which limits County Code Enforcement and/or Building Division action against a property owner within Board designated “Unrecorded subdivisions” for any unpermitted construction improvements on the owner’s property which were completed before June 1, 2024. The ordinance also provides a process for owners with qualifying unpermitted Construction to cure Code Enforcement or Building Division violations for building without a required permit.
By a Resolution adopted October 1, 2024, the Board designated the unrecorded subdivisions of River Ranch North and River Ranch South as Unrecorded subdivisions for the purposes of Ordinance 2024-065. Staff has identified an additional area commonly known as River Ranch North and described on the attached Resolution which meets the requirements stated in Ordinance 2024-065 to be designated as an Unrecorded subdivision.
RECOMMENDATION
Approve a Resolution designating the area of property generally known as River Ranch North as an Unrecorded subdivision pursuant to County Ordinance 2024-065.
