DESCRIPTION
Many of the roads in the State of Florida and within Polk County were constructed years ago with narrow or non-existent rights-of-way. To correct this situation, Florida Statutes allow the State, County, or Municipality to file a map as prima facie evidence of ownership of the road with the Clerk of Circuit Court in the County in which the road lies. The State, County, or Municipality is required to certify that it has maintained the roads continuously for a minimum of seven years.
Maintained right-of-way maps have been prepared for the following roads lying within Polk County:
1. 2nd Street West from its intersection with Rifle Range Road westerly for approximately 1,110 feet to its dead end. The right-of-way is located in Section 17, Township 29 South, Range 26 East.
2. 12th Street East from its intersection with Rifle Range Road easterly for approximately 300 feet. The right-of-way is located in Section 21, Township 29 South, Range 26 East.
3. Peerless Road from its intersection with Prairie Industrial Parkway easterly for approximately 500 feet. The right-of-way is located in Section 3, Township 30 South, Range 23 East.
4. Reynolds Road from its intersection with Alturas Babson Park Cutoff Road northerly for approximately 1.5 miles to its intersection with Cox Road. The right-of-way is located in Sections 17, 18, 19, and 20, Township 30 South, Range 26 East.
The maintenance units in which these roadways lie have maintained the roadways for more than seven years and will certify the maps. Approving the recording of the maintained right-of-way maps will fulfill the requirements of the Florida Statutes and give public notice of the County's ownership of the rights-of-way.
RECOMMENDATION
Request Board approve the aforementioned maintained right-of-way maps.
