Approve Infrastructure Agreement between Polk County and Lake Gibson Owner, LLC for Walmart Entrance at Daughtery Road (Estimated $142,601.83 one-time expense)

DESCRIPTION
The Lake Gibson Owner, LLC has property on Daughtery Road that they are developing. They currently have an Agreement with the County for designing and constructing a signalized intersection at the intersection of Daughtery Road and the Walmart Entrance on Daughtery Road. While working on the intersection improvements an existing drainage issue at the truck entrance to Walmart off of Daughtery Road appears to have been exacerbated.
The County contacted the developer to discuss addressing this drainage issue. The developer agreed to enter into the attached Infrastructure Agreement for a 75/25 County/Developer spit of the costs. The estimated costs of the improvements is $190,135.77. The County staff will be able to approve over-runs up to 10% over the cost estimate or a total of $209,149.35.
RECOMMENDATION
Board approve and sign the Infrastructure Agreement between Polk County and Lake Gibson Owner, LLC for Walmart Entrance at Daughtery Road.
FISCAL IMPACT
Funds are available in the Roads & Drainage approved CIP under Developer Agreements.
