DESCRIPTION
The County received a petition from Mattaniah S. Jahn, Esquire, as authorized agent for Jason and Jamie Bogdan to vacate a portion of a platted utility and drainage easement lying over Lot 23, as shown on the plat of High Glen, recorded in Plat Book 66, Page 46, Public Records of Polk County, Florida. The subject easement is located in Section 17, Township 29 South, Range 24 East.
The Plat of High Glen, filed in May of 1978, dedicated all rights-of-way and easements shown thereon to the use of the public. The petitioners are the owners of Lot 23 of the plat which contains a single-family residence and is encumbered by a 30-foot-wide platted utility and drainage easement along the northern (rear) boundary of the property. The petitioners have requested the vacation of the south 20-feet of the easement in order to clear an encroachment of a portion of a shed and a screened room that was built without a permit in order to resolve an open code enforcement case. Vacating the requested portion of the easement will eliminate the existing encroachments which will allow the petitioners to move forward with clearing the code enforcement item and more fully utilize their property.
The City of Lakeland Electric and Water/Wastewater, and Frontier Communications have no objections to the proposed vacation.
The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections to the proposed vacation.
RECOMMENDATION
Request Board adopt a resolution to vacate a portion of a platted public utility/drainage easement as shown on the plat of High Glen, as fully described in the legal description contained in the petition and resolution attached hereto.
