Accept a Utility Easement from Desmond Surujbali in conjunction with bulk wastewater services to Briarwood Estates Mobile Home Park. (No fiscal impact)

DESCRIPTION
In July 2022 Polk County entered into a Bulk Wastewater Services Agreement with the owner of the Briarwood Estates Mobile Home Park (“Briarwood”) to provide bulk wastewater services to the park. The ownership of Briarwood was subsequently conveyed to Desmond Surujbali and in May 2023 an Assignment and Assumption of Bulk wastewater Service Agreement was entered into by all associated parties. As part of the agreement the property owner agreed to grant an easement to Polk County to accommodate a lift station needed to provide the wastewater services to Briarwood. A rectangular shaped easement area has been identified along the northern boundary of Briarwood containing approximately 3,000 square feet which will accommodate the construction and future maintenance of the lift station and the owner has executed and delivered a Utility Easement to the County. Accepting the Utility Easement will give the county the easement needed for the construction and operation / maintenance of the proposed lift station and fulfill the terms of the Agreement as it pertains to the easement.
RECOMMENDATION
Request Board accept the above-mentioned Utility Easement.
