Authorize a County Deed to Eagle Haven Ranch Properties, LLC associated with vacated right-of-way for a portion of Shady Oaks Drive. (No fiscal impact)

DESCRIPTION
On July 16, 2024 the Board adopted a resolution vacating the northern portion of maintained right-of-way for Shady Oaks Drive upon petition by the adjacent property owner Eagle Haven Ranch Properties, LLC (“Eagle Haven”). Eagle Haven is currently having the property surveyed and plans to construct a fence and gate in, and around, the area which was vacated. Eagle Haven owns the majority of the property lying adjacent to the vacated right-of-way; however, the County owns property adjacent to the east of the vacated right-of-way. Due to the location and positioning of the subject vacation area it is difficult to determine what the resulting assemblage would, or should, be due to the vacation of the right-of-way. It was anticipated that the vacated right-of-way would be assembled with the Eagle Haven property and to avoid any confusion it is requested that the County convey any interest it may have in the subject vacation area to Eagle Haven. Authorizing a County Deed to Eagle Haven Ranch Properties, LLC will release any interest the County may have in the vacated right-of-way and will assist in clearing any clouds on the title caused by the County’s potential interest.
RECOMMENDATION
Request Board authorize the aforementioned County Deed for the conveyance of the County’s interest, including any that may otherwise be reserved by Florida Statutes, in the above-mentioned vacated right-of-way to Eagle Haven Ranch Properties, LLC.
