DESCRIPTION

This is a County-initiated request for a text amendment that would change the responsibility of performing annual mining inspections on non-phosphate mines from Code Enforcement to Land Development.  State law requires one Planning Commission hearing, which was held on February 6th, 2024, with a recommendation for approval (Vote 6:0). 

 

Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan.  Amendments to the LDC require two public hearings before the Board to be adopted.  This is the first of two hearings.  The adoption hearing is set for March 19, 2024.
