DESCRIPTION
The owner of a vacant residential lot located along Athabasca Court in the Poinciana area contacted the County regarding the adjacent roadway's location in relationship to the platted right-of-way. The plat filed in 1974 dedicated various rights-of-way to the public including the right-of-way for Athabasca Court which terminates in a cul-de-sac. A review of the roadway shows that the cul-de-sac was constructed approximately 100-feet to the south of the right-of-way area meant to accommodate for it on the plat and encroaches slightly into two residential platted lots. The roadway was constructed over 30 years ago and has been maintained continuously by the County since that time giving the County statutory right-of-way over the limits of the roadway as maintained. The current owner of one of the two residential lots, Maronda Homes, LLC of Florida, has plans to construct a single-family residence on the lot and contacted the County regarding the location of the roadway. After further reviewing the area it was determined that the cul-de-sac cannot be relocated due to unsuitable conditions to the north, which is likely why it was constructed in its current location. In order to establish a documented right-of-way line for setback and permitting purposes the owner has agreed to convey the area over which the current roadway lies up to the edge of pavement as additional right-of-way and has agreed to grant a 15-foot wide easement adjacent thereto for drainage and utilities which would normally be accommodated for in the right-of-way.
