Accept a Polk County Utilities Easement from Blackwell Villa Association, Inc. in conjunction with a proposed water main pipe replacement project within the Blackwell Villa’s unrecorded subdivision. (No fiscal impact)

DESCRIPTION
Polk County Utilities had a project to replace old water meters and make general upgrades to the potable water system within a private road subdivision known as Blackwell Villas located in the Babson Park area. The water main which services the subdivision is located within the right-of-way for a private road known as Blackwell Villa Cove. Prior to the project it was discovered that no easements could be located for the water main located within the private road right-of-way. The County contacted the property owners association which owns the road right-of-way, Blackwell Villa Association, Inc. (“Blackwell”), regarding the planned improvements and the lack of existing easements. Blackwell granted a right of entry to the County to allow for the upgrade work to be performed and also agreed to grant a perpetual utility easement over the road rights-of-way once the work was completed. The proposed upgrades have been completed and Blackwell has executed and delivered a Polk County Utilities Easement to the County. Accepting the Polk County Utilities Easement give the County the easement needed to operate and maintain the water main and system within the subdivision.
RECOMMENDATION
Request Board accept the above-mentioned Polk County Utilities Easement.
