DESCRIPTION
On November 1, 2022, the Board approved an Interlocal Agreement between Osceola County and Polk County for Maintenance for the Watermark Boulevard (A.K.A. Spine Road) Project. There is a proposed development, mainly in Osceola County, that is accessing from Cypress Parkway in Polk County. Approximately 0.08 miles of the main access road, Watermark Blvd (A.K.A. Spine Road), is located within Polk County. To address any confusion regarding ownership and maintenance of the right-of-way and associated infrastructure; Osceola County and Polk County staff agreed to enter into an Agreement to define the responsibilities for this section of roadway. Osceola County became the maintenance entity for the portion of the roadway in Polk County. This Agreement does not include any financial responsibility to Polk County for this roadway.
The development is currently permitting a Phase of the development that is in Polk County. Lassiter Way is the main roadway in this Phase that connects to Cypress Parkway in Polk County and Watermark Blvd (A.K.A. Spine Road) in Osceola County. In addition, Gingham Drive connects to Lassiter Way in Polk County and extends into Osceola County for another Phase of the development. The attached agreement addresses any confusion regarding ownership and maintenance of the right-of-way and associated infrastructure; Polk County will become the maintenance entity for the portion of Lassiter Way in Osceola County and Osceola County will become the maintenance entity for the portion of Gingham Drive in Polk County.

RECOMMENDATION
Request Board approve the First Amendment to the Interlocal Agreement Between Osceola County and Polk County for Maintenance for the Watermark Blvd. (A.K.A. Spine Road) Project.
