DESCRIPTION
The Florida PACE Funding Agency has sent correspondence to the Polk County Tax Collector asserting that the Florida PACE Funding Agency is a statewide governmental entity and that tax collectors do not need authority from the city or county to put PACE assessments on local tax rolls based on a bond validation case filed in Leon County. The Tax Collector has informed the Board that he disputes the assertions from the Florida PACE funding agency. The Board has stated that it desires to join litigation that contest the ability to collect non-ad valorem assessments on property located in unincorporated Polk County without Polk County entering into an interlocal agreement authorizing such assessments.
RECOMMENDATION
Adopt the proposed resolution supporting the Polk County Tax Collector regarding PACE Special Assessments.
